I’m thoroughly confused right now. Does Ohio withhold 4% or 6% from W2-G jackpots? I’ve had reports of both of these figures, but I assume it is standard across the state. Can some of you actually look at your W2-G’s and verify the percentage in the “State tax” box.

I just received this from someone who lives outside the Cleveland city limits, but plays at Cleveland Horseshoe Casino:

<<I just received another W2g this past Friday. Box 14, labeled State Income Tax withheld, has 6% of my jackpot total. Nowhere on the W2g is there any mention of City Tax.>>

This verifies the previous info I had that Cleveland only taxes residents so would only withhold for residents. Since Columbus and Cincinnati taxes both residents and non-residents I believe that both of those withhold city taxes for everyone. Can some of you personally verify those details by looking at your W2-G’s from each of those cities, and be sure to add whether you are a resident of that particular city.

This subject may put me over the edge!!!! I’ve combed the Internet and not found this specific information.

Jean

You may want to consider sending an e mail each of the casinos and ask them
what the withholding rates on W2G’s are for Ohio and respective City. I
would think that they would respond to your question in a timely manner. I
can’ imagine that the WH rate would be 6% unless they are combining the city
and state tax WH.

Maybe this will help some, Jean. It appears that 6% was withheld until June 12, 2012. Thereafter it was 4%:

"Pursuant to R.C. 5747.063, if a person's winnings at a casino facility are such that the IRS requires reporting on form W-2G or 1042-S ($1,200 or more not reduced by the wager for slot winnings; more than $5,000 reduced by the wager or buy-in for table win; or $600 or more if the winnings are more than 300 times the amount wagered or are subject to federal income tax withholding), the casino operator shall deduct and withhold Ohio income tax from the person's winnings at a rate of four percent (4%) of the amount won. (Please note that, prior to June 12, 2012, each casino operator was required to withhold Ohio income tax at a rate of six percent (6%) for those people meeting the thresholds mentioned above.)"

That's from the Ohio Dept of Taxation website:

http://www.tax.ohio.gov/faq/tabid/6315/Default.aspx?QuestionID=627&AFMID=11354

That link should open to FAQ #52, "Will the casino withhold any amounts from my casino winnings for Ohio income taxes?"

The confusion lies in the fact that the W-2G forms used by Cleveland, Cincinnati and Columbus do not have a separate box for local income tax withholding. I have no idea why they don't as I have W-2Gs from one casino in IN that has a box for local withholding even though there is no local withholding there. I've also seen versions of W2-G forms on the IRS website that also have box for local withholding.

Each of the 3 OH casinos I've visited seem to do it differently.

Cleveland just dumps the state and local both into Box 14 at a 6% rate (4$ state and 2% city) and makes no mention anywhere on the form that this is a combination of both.

Columbus dumps the state (4%) into Box 14, but then has this footer under the signature line that says "Local Tax Withheld xx.xx" which is at the 2.5% rate for Columbus. Your payout is the jackpot amount minus both he Box 14 and the local line item withholding.

Cincinnati dumps both state and local into Box 14, They have a footer under the signature line that says "Box 14 includes 4% state and 2.1% city tax withheld.

Someone else can verify Toledo, but it wouldn't surprise me to see a fourth way or reporting the local tax in OH W2-G.

One other oddity about Cincinnati is that they pay you on the spot from the slot attendant's pouch in cash and don't give you an actual W-2G at the time of your jackpot. You get this pink W-2G guest receipt and then the actual W2-G document arrives in the mail 2-3 weeks later.

Thanks!
SB
