Yes, I'm afraid so. Mississippis has a written regulation that says 80-100% only. No over 100%. But from what I understand, the reason that Copa and Casino Magic Bay St. Louis has been able to have FPJW and 10/7 DB (and FPDW at Copa) has something to do with the "platform" that these games are on. I have no idea what that means except that it somehow has to do with the mix of other games that aren't positive. Bally is claiming that they'll bring the All American game back on a different platform also.
I am drafting a letter to the Director of the Commission suggesting that if the reason for that reg. was ever valid, it no longer is and could we change it. It's a regulation only, not a law, but it still may take legislative action to change it.
The point of an initial letter is to just find out why that reg is in there and if there's any chance to get it changed.
We may have to resort to a letter-writing campaign later.
I'm also drafting a letter to the 2 or 3 casino assocations asking for their support, that it would be beneficial to casinos here to compete with Nevada. After all, if someone had a choice between a 3-hour flight to LV and a 5-hour drive to Biloxi, what reason do they have for going to Biloxi if they know beforehand they don't have a chance at VP.
If anyone knows of another jurisdiction that is like Nevada and allows positive games, I'd appreciate knowing about it.
Please don't blow off Mississippi altogether. There are still some casinos here that will give you a good gamble for your dollar, like the Copa (who by the way also refuses to import 6:5 single-deck BJ and still offers 3:2). VP is heating up in Tunica, though it's still not quite what I would call really really good, but at least casinos there have too much pride to switch to 6:5 SD BJ. Biloxi does have NSUD in quarters and 50-cents at Palace (3X points twice a week), and all but 2 casinos have 9/6 JB and some good promos. Other good plays that I won't get into here.

This is a serious post so don't just blow it off. Does MGC actually
have a policy against positive return machines or do their actions
indicate an unwritten policy? Biloxi is one the few places we enjoy
gambling at anymore. It seems a shame that a government entity has
to help the casinos in their work to take money from their guests.
Our list of places we DON'T visit anymore because we don't get a
fair shake seems to grow every year. It would be a shame to add MS
to that list.
