STAY AWAY FROM NEW YORK, NEW YORK

I agree and found the e-mails between me and my host (which i have pasted below) regarding my last two trips to NYNY.

It seems that he is correct and that for some reason tihs trip I was RFL instead of RFB which I was the previous trip.

Based on the e-mail, is NYNY obligated to pick up a certain amount of F&B? If they are, does anyone know what that amount is? I may not let this drop if I have recourse based on principal.

Joel

Hi Joel,

You are all set up for your 12/28 trip. Your offer for December will
give you the three nights comped, $250 in free play and limited food and
beverage. I comped the second room for you as well..

I will see you in a couple of weeks...

Best regards,

Steven

Hi Steven,

We'd also like to come in on Dec 28th for (3) nts if available leaving
on the 31st.

There will be (4) of us (me, my wife, mother in law and daughter) so
whatever you can do for rooms / suites or RFB would be great.

See you in a couple of weeks.

Regards,

Joel

Hi Joel,

You are all set up. I have you in a suite at RFB and your brother in a

non smoking Broadway deluxe. I have your room from
10/28 thru 10/30 and
your brothers room checking out on 10/29. Have a safe trip in and
please let me know if there is anything else that I can do for you.

Best regards,

Steven

Guess it also doesn't hurt to ask for an email confirmation of the

reservation and comp, or a hard copy - just tell them you've had
trouble with another property in the past, and if they squirm at
putting it in writing, you might be a little suspicious.

Whatever you do, get it in writing, get confirmation numbers, take
pictures, take names, make copies, if you have to pay, pay with a
credit card so there is a record, etc., that way you can nail them in
the courts when they try to jerk you around, which they will do.
Casinos think they are above the law, they most certainly are not. Buy
''Beat the Players'' if you want to know more.

Think this can't happen to you?

Joel,

I understand your indignation very well. It's rational in this
circumstance. However, without diving into my more typical diatribe,
when you start speaking of recourse in a case such as this you're
simply chasing after a bigger slice of frustration.

Have a beer or two and set your focus on what was most satisfying with
the trip. Let this go, satisfied that at least you're a little wiser
for the experience and, better yet, you've alerted others to the
potential pitfalls that may lie in a NYNY stay.

Joel, "limited food and beverage" often means you are limited to the
cheaper restaurants. Sometimes it is just the coffee shop. They
should have made that clear to you upon check-in.

In general, I would disagree with Harry about pursuing things like
this. You can often get some satisfaction, both financially and
emotionally. I would write a letter to your host expressing your
surprise and disappointment. Say that you relied on his email that
at least some food and beverage would be comped. Ask what exactly
they did comp in the way of food and beverage.

If he writes back to say it was only for the cheaper restuarants,
you write back saying someone should have told you that. You can
maybe cc a couple of higher-ups at this point. If the host does
not offer you enough to make you happy, threaten to take him and
NYNY to Small Claims Court. It's best if you threaten to take them
to court in your home state. You may or may not be able to do that,
depending on your home state's rules. (But you can at least
threaten it, either way! ;>)

I had a problem with an airline fairly recently that they said,
because of their written rules, was not their problem. I said that
they had so mis-handled the situation that their written rules no
longer applied. They offered me a token amount, which I refused,
and I said I felt strongly enough to pursue it in court. They then
sent me the full amount.

Good luck,
