The "facts" you cite are specifically disclaimed by the BBC , have no verifiable source, and are attributed to a plaintiff lawyer-related "consumer" group, whose alleged website does not respond. In any event, the legal definition of negligence does NOT mean guaranteed safe against any kind of misuse or idiot behavior.
