Sister-in-Laws banned and not paid $2,000 jackpot

Went to Pauma today, Sunday the 25th. Was told by players club desk person that the woman who actually pushed the button that hit the winner (not her card in the machine but they didn't care about that) refused to sign a W2G stating she already had IRS problems. She wanted her sister in law to get the payout since it was her card in the machine. They refused and the argument began.
   This seems to be the Pauma version. I didn't ask about the "interrogation" or the "life time ban".
   I am not a fan of Pauma, have never played much there (7* at Harrahs) nor care much about the Sisters-in-law situation. Just relating what a Pauma employee said. By the way, the place was packed at 3:00 this afternoon.

They feel and I disagree that is what the federal guidelines require if no SSN is provided (and with no ssn provided no w2g would filled out for her to refuse to sign).
I have showed them that the irs requires witholding of 31% in that situation , they have showed me per Circular 131 ?? that they can not. I disagree with their & their lawyers interpetation but my family & the tribe been friends since the 40s so I just smile ; )

While they are a sovgrein nations , all native casinos do worry about what the feds think. History I guess.

The casino is 100% wrong that they must give the W-2G to the player who
pushes the button. In fact, the law is spelled out in IRS publication 3908,
"Gaming Tax Law and Bank Secrecy Act Issues FOR INDIAN TRIBAL GOVERNMENTS":

"When paying out a prize from a wagering activity, a tribal gaming operation
needs to determine whether the prize is being paid to a member of a group of
two or more winners on a single ticket, or is being paid to a person who is
not the actual winner.

"If prizes are paid to a member of a group of two or more winners on a
single ticket, or paid to a person who is not the actual winner, the tribal
gaming operation must complete IRS Form 5754, Statement by Person(s)
Receiving gambling Winnings. The completion of Form 5754 enables the tribal
gaming operation to prepare Form W-2G. There are two parts to Form 5754 -
the first lists the identification of the person to whom the winnings are
paid, and the second part lists the actual winners and their respective
share of the winnings. The tribal gaming operation must use the information
to complete Form W-2G for each winner. Form 5754 is not submitted to the
IRS, but should be kept with tribal tax records for a period of four years.

"The determination of whether a Form W-2G is required is based on the amount
of the prize paid on the winning ticket, not each individual's share of the
prize."

If you look at the bottom of form W-2G, it requires you to sign under
penalty of perjury that you and you alone are benefitting from the prize.
Casinos are required to complete form 5754 if that is not the case. However,
many casinos (and even the Nevada Gaming Control Board agents) are
vehemently incorrect about this regulation. It may take repeated polite
prodding to get them to follow the law correctly.

Great IRS info - Cogno,
Just amazing. What a mess. I didn't like finding out about the IRS
problem one of them was having. But from the IRS reg, the casino is 100%in error and should very quickly suck it up and - Make Nice :slight_smile:
I blame it on management and if mgmt doesn't fix the problem the owners need to clear it up.
