Yes and no. With your generic wording, if you turn away
someone in a protected class you create a legal risk (no
matter how small) that is easily avoided with their wording
choice. On one level it's pretty smart. What's the downside
for the Silverton -- a slew of AP's avoid their casino because
there's no way to eek out a profit, boo hoo.

But World, protected classes are always protected regardless of the
wording.

Agreed, but this way there's no ambiguity
about why someone is being chosen. As I said
the risk is small but attorneys spend their
lives worrying about miniscule risk frequently
to the detriment of the business they support.

I still havn't heard the downside for the
Silverton in all this.

Are you serious? Promotions are to PROMOTE business, that's from basic
marketing 101. Almost all gamblers think they can gamble with an
advantage, most don't realize how much the odds are stacked against
them by the casino. Casinos should, and usually do, loudly and
regularly proclaim what a bunch of winners their customers all are,
even if it's marketing bullcaca. By proclaiming that they are going to
go after so-called ''Advantage Players'' (what are they going to do?
backroom them?) they scare away regular customers who already think
their chances of winning are slim. They may as well announce that the
winner of the drawing will be promtly congratulated and then 86'd, or
that anyone who enters the drawing with more than a few tickets will
be 86'd. It's like Fat Tony inviting you to throw dice with him, which
he's not very good at, of course if you win, well, that makes Fat Tony
very angry, capish? If Fat Tony is reading this, once again, I'm sorry
for beating you at dice, are we cool yet? As for the very small
minority of gamblers who assume they are going to lose, and yet they
still gamble, shame on the casinos for picking on them. Of course, I'm
sure the casinos feel as guilty as a used car salesman who's just
unloaded a lemon or a congressman who accepts bribes.

Since my first answer to this question was probably obtuse, I have a
simplier answer. If Silverton wishes to exclude the wise guys from
this promotion, this won't work, they'll simply hire runners. It may
be that some flies complained about high rollers winning all the
drawings, and maybe Silverton thinks this will placate those fleas.
But mostly this will confuse existing and potential new customers, in
other words, it will drive away some lucrative business. Some card
clubs actually have an ''Advantage Level'', maybe some people will
think they are excluding those who play too much, so they will play
less, to make sure they don't get this level. But overall it just
looks like Silverton is targeting winners, and that's unAmerican, in
this country we celebrate our winners, and we reward them, with lower
tax rates for example, and express airport checkin, and special
freeway lanes ... It's socialist countries that try to persecute
winners. Cue Springsteen ...
