Refund of US Jackpot Withholding Tax

A pleasant surprise awaited us when we returned home last Saturday,
having been away for close to three weeks - our refund cheques from the
US Treasury had arrived. The 1040NRs were mailed on January 11, so
that's a pretty good turnaround time.

Both my wife and I reported losses equal to the jackpot winnings, and,
obviously, the IRS accepted our word.

I can't help wondering, however, if this will always be the case. Has
anyone filing a 1040NR ever been asked for proof of losses?

Neil

I haven't as yet. I would imagine that it would only
become a problem if your numbers changed
significantly.

If you got lucky and hit megabucks for a few million
and said that your losses that in the prvious years
were $3000 were now $300,000 they might want to see
some proof, but if you always put in for losses around
3 - 5 k and stay in that range or progress upwardly
slowly I think you would never have a problem.
