Palms False Advertising

Don's complaint is perfectly justified, based upon what he quoted, but there
are a couple of things we should keep in mind.

First, this subject has been discussed here in detail before. I have posted
repeatedly that the Palms' point multipliers, with the exception of the LVA
coupon, are no good on 100% machines.

Second, on the same mailer as Don quoted from, there are two other "ads" for
the multiple points. Under each one of these it says, "See Club Palms for
details." The slot club folk are aware that the 100% machines are exempt from
the multipliers, and will tell you this if you inquire.

I completely agree with Don that the word, "any" before "Video Poker" should
not be there. But in my opinion it does not rise to the level of "False
Advertising." Especially since you can see, right on the machine as your points
accrue, that your either are or are not receiving double points.

In the monthly mailer from the Palms for November, it states:
"Come in any Sunday during the month of Novemebr and you can earn 5x
points on any reel machine and 2x points on any Video Poker machine."

When I complained this morning at the Club Palms booth that I wasn't
receiving 2x points on the $2 10/7 DB machine, I was told that full

pay

machines were not eligible.

So "any video Poker machine" does not mean all video poker machines.

I have a lot of respect for Brian's opinion, and as such as the case
here, generally concur.

I'd like to make a side point here, which is, "why bother?" Unless you
were a career dollar player and content to bang out $60/hr or so over
the last several months when the $1 10-7 progressive had a total of
1+% meters, opportunities there are scarce. Myself personally, I like
their nightlife and am willing to play for comps and discretionaries
(and let's not forget Visa cards) there, but the idea of actually
making money there (outside of the 10-7) is ridiculous. Even in
play-scarce Vegas (and can someone confirm that the Cannery has cut
back their 100 coin 4K coupon to $250 max?), there are better options
out there.

It's materially misleading and should be grounds for a hearing for
license revocation.

They can't reserve rights that they aren't legally entitled to
reserve, i.e. they can reserve rights, they cannot reserve wrongs
(illegal actions).

I'm no lawyer, but this seems no different
than disallowing the use of an existing coupon
or otherwise excluding machines from a given
promotion. Seems to me the phrase is
self-explanatory (heck they don't even have to
let you in the door if they don't want) and no
one's doing anything illegal here. But again
I'm no lawyer.

I have stayed out of this discussion because I no longer play at the
Palms. Being a non-local and a low-mid roller, the Palms and I are
not a good fit. Also, being about to approach very advanced youth,
the ambiance of the Palm's casino is more suited to my Grandsons!

However, I feel obligated to point out that the Palms is actually
giving their players a nice opportunity to receive 5X points. I
agree that the marketing department would be well advised to more
carefully proofread the verbiage employed in their offer
announcements. However, I also believe that the Palms management is
entitled to restrict their playing enhancements in any way that they
deem necessary in order to run a profitable business. Would it have
been better had the Palms offered NO 5X points opportunities,
thereby not restricting the offer to certain less than full pay VP?
I don't believe so.

Palm's players are still free to play the 100% games offered w/o
taking advantage of the 5X points, or the less advantageous games
which are eligble for the extra point accrual. What is the problem
with that?

Surely, even though the Palm's offer mentioned receiving the 5X
points on "any VP", most knowledgeable players who read this board
regularly, are and have been aware, that the Palms has always
excluded their advantage plays from this type of offer. So, I have
difficulty believing that, when this restriction was explained by
the boothling, that this would have come as a big shock. I know
that I have read many posts by both Brian and Jean, which verified
this fact during the discussion of previous offers.

I do believe that in this current climate of shrinking VP
opportunties, that we should try to be a tad more tolerant of the
casinos that still offer some advantage play as well as an
occasional extra enhancement. Just my opinion of course, But one
that is firmly held.

For the sake of accuracy 5X is on slots, VP is 2X

Guys,
Its over...lets go forward...here's what I posted on the LVA Forums:

···

-------------------------------------------------------------------
In all fairness, the Palms usually excludes all 100% games from its
promotions...but when the flyer specifically stated "any Video Poker
machine"...I thought this promotion included them.

IMHO, nothing will be accomplished by trying to bring this to
a "higher" level.

I vented, sent the Palms an e-mail and now that my fantasy of playing
the $2 10/7 DB for 2x points, in conjunction with their Holiday (XMas)
gift card promo, has been shattered...I've returned to
normal...whatever that is

the bottom line is that palms has alot of good games fpdw prog. 10/7 db

Hi Doc,

I quite agree that most of what can be said has already been posted on
this board. Now on to bigger and better jackpots, 10X points, and
triple Cashback!

BTW, Doc, do you still have some of that laughin' gas left? I need a
refresher whiff! ((O:
