NRS 465.075; legality of Computers, Strategy Cards, within Casinos

NRS 465.075 Use of device for calculating probabilities. It is
unlawful for any person at a licensed gaming establishment to use, or
possess with the intent to use, any device to assist:

      1. In projecting the outcome of the game;

      2. In keeping track of the cards played;

      3. In analyzing the probability of the occurrence of an event
relating to the game; or

      4. In analyzing the strategy for playing or betting to be used
in the game,

except as permitted by the commission.

      (Added to NRS by 1985, 970)

Original intent of enactment was to deter use of concealed computers
at Blackjack (with typical rules, player would have at least a 3%
advantage). Believe there's been at least one successful
prosecution; a Nevada court found the law constitutional.

Does anyone have any opinion/information as to whether use of
strategy cards, and/or pocket computers, at Video Poker, is "at all
likely" to result in prosecution under this law?

There have been any number of threads/posts about this in the past, and, as best I can recall, they have consistently indicated that a pocket computer is impermissible as a "device", but that strategy cards are legal ... with the fairly typical admonition that a little discretion in the use of a strategy card wouldn't hurt, either. I have used my own cards in casinos without anyone ever questionning me; of course, I don't need to refer to them nearly as often as when I first started (never really need to on JoB anymore, but I haven't quite developed complete confidence in my memory for other games, as little as I actually go). This is not a 'legal opinion'; I'm not licensed in states where casinos are permitted, nor have I conducted any legal research on the issue. ... But frankly, I can't recall a single post on any of the numerous VP groups that I'm on, ever indicating that the use of a strategy card is either prohibited by casino policy or is illegal. Let me also make full-disclosure by informing you that I am in the process of making preparations to commercially market my own strategy cards, in case you think that this might have influenced what I have just posted.

I won't play lawyer, but I can tell you from a practical standpoint that I and many others have used strategy cards and not been arrested, prosecuted or even noticed:-)
