no over 100% vp allowed

In a recent talk I had with a Tunica casino slot manager, I was
told, "I would like to offer a 100% plus game, but Mississippi won't
allow it."

This shocked me and I went online to try and find out some reason for
this regulation. (It isn't law but a MS Gaming Comm. Regulation
(http://www.mgc.state.ms.us/pdf/regs/mgcregs.pdf) that slot
payouts "must not be less than 80% or greater than 100%")

I searched the internet for hours and did find out that many other
states also have maximums on the amount that machines can pay out but
I did not find a single item addressing the why of these laws or
regulations.

Can anyone tell me the why? Has anyone tried to get their state laws
changed to allow the positive pay machines?

Whoever said that is full of something, and intelligence is not it :wink: Go to the Copa (in Gulfport, M-I-S-S-I-S-S-I-P-P-I) and there should be several positive machines.

With progressives, or cashback and comps the machines can be
positive, but the regulations still read the BASE payback can't be
over 100%. (read the regulations if you don't believe me, in section
IV, link posted below)

I was given the explanation by someone that the concern is that 100%
return games provide an avenue for money laundering. While it seems
modestly far-fetched, I can place reasonable credence in the reasoning.

A 100%+ game, when played with appropriate strategy, gives the player
the expectation (not assurance) of a full return of their wagers.
This presents a means by which one could launder ill-gotten money
under reasonably favorable terms (transforming under-the-table money
into W2-G documented legitimate income).

The far-fetched part is that anyone might actually resort to this and
that spending or investing such "legitimized" income wouldn't attract
as much scrutiny as the pre-laundered cash would. However, that a
state might latch onto this rationale as justification for a 100%+
prohibition is very easy to believe.

Two years ago I spoke to the then Slot Manager of the Copa about this
as the Copa is known for their PE games. He told me that the
Mississippi Gaming Commission had questioned him about the 100%+
return on his games. His defense was that the 100%+ returns
were "theoretical" only, that the actual payouts on the games were
less than 100%, and he showed them the appropriate records to back up
his assertion. The games are still there so the MGC must have agreed
with his reasoning.

The reason that many states have regulations that prohibit 100%+
games is probably due to their copying of Nevada gaming regulations.
As surprising as it may seem, I have read that Nevada gaming
regulations also contain a provision against payouts exceeding 100%.
