LVA Question of the Day - 8 OCT 2006

Q: I've been invited to participate in Harrah's Millionaire
Maker video poker tournament. I've been in many slot tournaments,
but not in a video poker tournament. Do you have any tips and
pointers for a video poker tournament?

  I know this has been discussed here before, so I apologize for rehashing the subject.
   
  Besides regular winnings, it's my understanding that cashback is taxable. Why is this? I might be wrong, but I believe rebates are not considered taxable income, but simply money being returned. Can't cashback be considered a rebate of your initial wager and not additional income?
   
  Bounceback can take various forms: cash coupons and freeplay are two of them. I can see that a cash coupon is additional income and therefore taxable.
   
  I think I've heard it argued here that freeplay itself is not taxable, only winnings derived from it. So let's say you play the freeplay through; whatever you cash out is taxable? So if you keep playing it and walk away with nothing, there would be no taxable income. But what if you hit a W2G in the process? It seems to me this idea is flawed, and that freeplay *is* income, or else you cannot offset it with losses.

The IRS does not address these specifically so each player (and each tax preparer) does what they think is the spirit of the law since there is no letter of the law. I know players who do count it all as income and those who count none of it - and all choices in-between!
