I bought a house in a development (The Racquet Club of Desert Shores) that
was then in the midst of a homeowner suit against the builders and the
original lawyers (who had attempted to defraud the owners by accepting a
short-change offer from the builders with a fast shuffle). Over the next
year, once the suit was won, there was a huge amount of work done, to the
benefit of homeowners of about $25,000 including a check and new roofs, for
me new stucco, new firewall where none had been installed, etc., etc., etc..
When I bought the house I was not even officially informed about the lawsuit
because of legalities. I knew there were problems with the house (not major
structural in my case; mainly cosmetic) and the outcome of the lawsuit was a
huge bonus to me once the months of construction, noise and dirt were over (I
had to install new broadloom in my living room because the dirt had destroyed
what was left of it).
The moral, if there is one; do more research than you are accustomed to
doing. And push lawmakers in Nevada to make the laws more (not less)
friendly to homeowners. There is a new law that may come into being that
will severely limit the rights of homeowners to sue builders. And there is
no way that I personally will ever leave my little house now that it has been
fixed to meet its original promises and specifications.
