In Pennsylvania and Ohio and other states I'm pretty sure that even bets
between 2 people or penny-ante-type poker games are illegal if actual money is
involved.

Yes, they are in PA. The cops busted a couple of American Legion Super Bowl pool's a few year's ago. I think it stunk.
