The problem with VLTs is RNG requirements vary. In West Virginia, for example, I was told--"do not assume that the RNG is the same as in Nevada because I do not know what software is used". This from Tracy Donovan after several calls--most officials were just unable to answer my questions. You need to be sure to ask the right questions and find a person with the answers--it may take several phone calls.

Also, ask about the maximum/minimum payback percentages. These can be changed by the state legislature--it was 87%-95% in Delaware. If you can copy down the pay table from the machine and determine the ER you may see it's outside the statutory requirements. For example, if the maximum theoretical ER is 95% and the ER with the given pay table is 97%, you can't assume it's an illegal machine. The state's definition for RNG could be different than what you believe it to be.

I will tell you that the 29 racinos operating in 9 states (approved, but non-operational in Florida and Pennsylvania) are a goldmine for local and state governments. In 2005 racetrack casinos contributed $1.28 billion in direct gaming taxes to state and local governments--that's a 20% increase over 2004. Simply put--you can't offer good games when you're being taxed to death.
