Anyone filed Schedule C in Kansas?

I played in Kansas for the 1st time this year on a short-lived big play. The state withholds a mandatory 4.5% from all W2G wins. Before proceeding to play I researched their tax laws, and as of tax year 2012, Kansas allowed losses to be deducted against W2G wins. In my experience, this is usually a good sign that there will be no/fewer issues with filing Schedule C and getting the appropriate amount of the withholding back. I proceeded to play…and in one 6-hour session I racked up almost $58k in W2Gs. The play was dead after that.

However…I just started filling out the forms for my non-resident KS return tonight to find that Schedule C income is not taxable in KS. At first I was pleased, but then that raised a red flag. I proceeded to look for info about the rules for gambling winnings on the KS Dept of Revenue website. Low and behold, in during 2013, they made a new ruling stating that gambling losses could no longer be claimed against wins. While this is not directly related to filing Schedule C, it does imply that getting any withholding back could prove very difficult.

So, I’m curious if anyone else has successfully filed on Schedule C and gotten any of their Kansas withholding back, or has had a similar situation in a different state. If you’d prefer, send a private message to v_p_pla…@…com

I checked the KS website and the 2013 tax booklet. You can deduct gambling losses in 2013. In 2014 you will not be able to deduct gambling losses. There is a change for 2013 that affects gambling losses and other itemized deductions. You will only be allowed to take 70% of your itemized deductions except for charity which will remain at 100%. Your taxable income will be taxed at a lower rate, but obviously this will not help much if you have a bunch of W-2s. Good luck with the Schedule C play. No more gambling in KS for me!

We went there in 2013 and had some withholdings, can out of state gamblers file something to get it back?

I see no one has answered your question. I have to wonder if this is a serious question or you meant to ask something more specific. You can file a KS tax return, but you will probably only get part of it back.

It is serious. Never gambled out of my state (Michigan) before in a state that withholds taxes, so I don't know what filing, if any are required (or desired if you can get some back).

OLD Info: 7 am to 7 pm. Sundays: 3x for Ruby, 4x for Sapphire, 5x for Emerald.

NEW Info, from my mailer: Sundays, Feb 9, 16, 23. 4x for Ruby, 5x for Sapphire, 6x for Emerald. There is no mention of specific hours those days. (I will double-check signs in casino today.)

Today’s (Super Bowl) multiplier is 6x for everyone and it is only from Noon-6 p.m.

You will have to file a KS tax return as a non resident. You can get every thing you need from their website. Even if you don’t get everything back most states (don’t know about Michigan) will give you a credit for taxes paid to another state. So that is another way you can get back what KS withheld.

Just closing the loop on this discussion. I filed Schedule C in Kansas for 2013, which triggered a request for some additional basic information from the Kansas Department of Revenue (copy of federal return, proof of Kansas withholding, and proof of adjustments to Kansas income). I received a return check shortly thereafter however it was less than what was requested on my return. I called them and discussed with an agent, and he quickly realized the error on their part. They sent me a report on the correction, an additional check for the difference plus interest on the full amount that they should have returned to me in the first place! By far the best service I’ve gotten from any state’s DOR or the IRS in similar tax reviews. That being said, with 2014 being the first year disallowing losses to be deducted against wins for recreational gamblers, it would be interesting to know whether it would’ve played out the same for this year…unfortunately I’ll never know since as I mentioned, the play is dead. If anyone plays and files schedule c in Kansas in the future, I’d be curious to hear if it is handled the same way.
