Excellent point. Jurisdictions have a novel way of dealing with gambling issues. Their approach is that it's illegal unless some specific form is formally legalized. As an example, California's compact with Indian tribes prior to Prop 1A allowed them to have any form of gambling currently permitted in the state. The problem was that asside from poker, some Aisian games, Bingo, and horse racing, there weren't any. This has been the common approach in most states, where legalizing specific forms of gaming has been brought on by voter initiative, with governments fighting it every step of the way. For years, Gov Pete Wilson refused to sign compacts with tribes that had already been approved by voters in the state. Only recently have many jurisdictions decided to refer the matter to voters directly as a way of generating revenue.
